The Planning & Zoning Commission serves a unique role in the Town's government structure, as it is expressly outlined in the Town's Charter. Additionally, the Planning & Zoning Commission has certain designated powers rather than simply serving in an advisory capacity.

 

Council Actions/Legislative Details: 

Article IX of the Keystone Town Charter gives the Town Council the authority to create and disband boards, commissions, and committees and confer upon the same such powers and duties as it deems advisable by Resolution or by Ordinance. Given this, all boards, commissions, and committees have legislative actions (resolutions or ordinances) that outline details related to their purpose, establishment,  and membership. 

 

The following are the Council Actions and Legislation that outline the details of the Planning & Zoning Commission: 

Section 9.3 of the Keystone Town Charter

Ordinance 2024-O-01 

Purpose: 

 

The following powers are outlined in Ordinance 2024-O-01: 

  • Review and decision as outlined in the Land Use Development Code. 
  • Review, adopt and amend comprehensive plans, sub-area plans, and special purpose plans for the use of land and physical development of the Town, which plans are approved by Town Council.
  • Make recommendations related to the drafting and development of the Town of Keystone Land Development Code.

Establishment: 

The Planning and Zoning Commission was initially created by the passage of the Town's Charter. Section 9.3 of the Town Charter indicates that the Planning and Zoning Commission is created  to assist the Town Council, in such manner as provided by the Town Council, in planning the development of the Town. 

Qualifications of Members:

Section 9.3 of the Town Charter indicates Councilmembers, the Mayor, or full-time employees shall not serve on the Planning Commission. Section 9.3 of the Town Charter also indicates that a majority of the membership must be Primary Residents of the Town of Keystone. Primary Resident is defined in Ordinance 2024-O-01 as the person is resided in the Town of Keystone for one (1) year and has been registered to vote in the Town of Keystone for one (1) year. 

Number of Members:  

Ordinance 2024-O-1 indicates that the Planning & Zoning Commission has 7 regular members and 2 alternate members. 

Terms of Members: 

Ordinance 2024-O-1 indicates that Planning and Zoning Commission members shall serve a term of three (3) years. For the first appointments in 2024, and to provide for staggering, three members and one alternate shall serve two (2) year terms and four members and one alternate shall serve (3) year terms.
